Brian Wells is the founder of Wells P.C. Brian has focused his career on litigation and intellectual property. He has counseled start-ups, small businesses, and Fortune 500 companies in a variety of industries, including medical devices, software, hardware, smart phones, cable, telecommunications, networks, financial services, voice technologies, speech recognition, and aerospace. He also has provides legal services to creators, producers, musicians, authors, and other artists.

Brian litigates for results. He has obtained favorable results for his clients in state and federal courts. He also has had success at a variety of administrative agencies. He has successfully litigated and defended claims for trade secret misappropriation, copyright infringement, and trademark infringement. He also handles claims involving contracts, real property, land use, securities, labor and employment, FOIA, HIPAA, debt collections, commercial paper, and bankruptcy.

Outside the courtroom, Brian has counseled clients to develop strategic IP portfolios that are aligned with their business objectives. He has worked with clients to generate revenue through IP licensing and enforcement. Philips et al v. ZOLL Medical Corporation (D. Mass.) – Represented medical device maker ZOLL Medical Corporation in a case involving defibrillator technology. Obtained favorable jury verdict on the two asserted patents.
Philips et al v. ZOLL LifeCor (D. Mass.) – Represented defendant ZOLL LifeCor in case involving wearable defibrillators.
Robocast, Inc. v. Microsoft Corp. (D. Del.) – Represent defendant Microsoft in case relating to automated web browsing tools. The case settled successfully.
Veveo, Inc. v. Verizon Services Corp. (S.D.N.Y.) – Represented Veveo in an action brought against Verizon for patent infringement, breach of contract, copyright infringement, and trade secret violations. The case related to technology for searching television programs and other content on cable networks and the Internet. The case settled successfully. Verizon agreed to license Veveo’s technology.
In re Certain GPS Navigation Products, Components Thereof, and Related Software (International Trade Commission) – Represented Honeywell to enforce multiple patents related to GPS and navigational system technology. The case reached a successful resolution.
In the Matter of Certain Machine Vision Software, Machine Vision Systems, And Products Containing Same (U.S. International Trade commission) – Represented Cognex in an action before the International Trade Commission seeking to stop the importation of articles containing Cognex’s machine vision technology.
ShopNTown, LLC v. Landmark Media Enterprises, LLC (E.D. Va.) – Brought patent infringement action for patents relating to web site architecture and functionality. Obtained favorable settlement.
Gold Medal Bakery, Inc. et al v. Michele LeComte Chambers – Successfully appealed a court order that was vacated by the Supreme Judicial of Massachusetts.

Rates Technology Inc. v. Qwest (D. Del.) – Defended Qwest in a patent infringement suit relating to least cost routing technology.
Realtime Data LLC D/B/A/ IXO v. CME Group et al. (S.D. N.Y.) – Representing NYSE Euronext, NYSE Arca, Inc., NYSE Amex, LLC in patent infringement suit for data encoding technology.
In the Matter of Certain Silicone Microphone Packages and Products Containing the Same (International Trade Commission) – Represented Analog in the ITC defending patent claims relating to Micromechanical Electronic (MEMS) microphone technology.
In the Matter of Certain Surface Mount MEMS Microphones and Products Containing the Same (International Trade Commission)- represented Analog asserted two patents in the ITC relating to Micromechanical Electronic (MEMS) technology
The Crystal Import Corp. v. Avid Identification Systems, Inc. (D. Minn.) – represented Crystal Import in antitrust litigation involving Sherman Act and Walker Process claims.
